The Colorado Court of Appeals recently affirmed a district court judgment, rejecting a plaintiff’s bid to overturn a trial court judgment in favor of a client of the firm.
The plaintiff sought over $1 million in damages at trial, but the court found that figure to be unsupported by the evidence at trial. While the judgment included a low five-figure award against our client, our client obtained a larger judgment in its favor, resulting in a net judgment in our client’s favor of approximately $12,000.
On appeal, the plaintiff argued the damages award was speculative and that the trial court wrongly limited its expert’s testimony; the Court of Appeals disagreed on both counts and affirmed the trial court’s judgment in full.
